# TERMS AND CONDITIONS OF USE
## 1. GENERAL INFORMATION
1.1 This document sets forth the terms and conditions governing the use of the website **backgammonshop.eu** and the purchase of products through the online store made available to buyers via this website.

These changes become binding and effective immediately for all users. You are responsible for regularly reading the website's Terms and Conditions; the version in force at the time of contract conclusion or website use shall apply.
1.5 By placing and accepting an order on our site, you (hereinafter referred to as Buyer) become a contractual client of the company SC PERFORMANIAX SRL (hereinafter referred to as BACKGAMMONSHOP).
**ORDER**: the electronic confirmation generated as a result of accessing the Online Store by a buyer, whereby they transmit to BACKGAMMONSHOP the intention to purchase products. An order becomes contractual only once expressly accepted by BACKGAMMONSHOP (via confirmation of product delivery).
**CONTRACT**: an order confirmed by BACKGAMMONSHOP, whereby BACKGAMMONSHOP agrees to deliver the ordered products (and only those products) in exchange for the confirmed price. The contract is concluded only upon the buyer receiving confirmation of delivery via email or SMS.
1.6 When using the service, you must provide only real, correct, current, and complete information, which you authorize us to use to process your orders and contact you. If this obligation is violated, we reserve the right to block access to the service temporarily or permanently, without prior notice. BACKGAMMONSHOP may refuse access to some or all functionalities of the online store or restrict the processing/delivery of an order if it deems that the user’s actions could harm its interests (e.g., fraudulent identities, payment fraud, bad faith actions). Depending on severity, BACKGAMMONSHOP may notify the competent authorities. Users can request information regarding restrictions applied to their account.

## 2. REGISTRATION AND ORDERING
2.1 Placing an order through the online store requires prior registration (client account). Any user/visitor of the website may register. By placing an order, you declare that you are over 18 and meet legal requirements to be a buyer.
2.2 By creating and using a client account, the buyer is fully responsible for maintaining account confidentiality (username/password) and for all activity conducted through their account.
2.3 By registering an order on **backgammonshop.eu**, the buyer agrees with the communication methods (email/SMS/phone) used to manage order-related processes.
2.4 To place an order, products must be added to the shopping cart, followed by payment through one of the available methods (online card payment or cash on delivery).
2.5 The notification received by the buyer immediately after placing an order has a strictly informative role and does not constitute acceptance of the order. Acceptance will be confirmed via email, SMS, or phone after order details are verified.
**Product Availability:**
* *“In stock”* – more than 10 units available.
* *“Limited stock”* – less than 10 units available.
* *“Out of stock”* – product unavailable (option for restock notification is available).

## 3. PRODUCT PRICES AND PAYMENT METHODS
* Prices are displayed in RON (lei) per unit and include VAT.
* Orders already confirmed are not affected by price changes.
* Invoices with VAT will be issued for every order.
**Payment methods:**
* **Online card payment** (processed securely via Netopia Payments, VISA/Mastercard).
* **Cash on delivery** (full payment in lei upon delivery by courier).

## 4. ORDER CANCELLATION / MODIFICATION
* Orders may be canceled by email or phone before handover to courier.
* Refunds will be processed according to the issuing bank’s policy.
* If the order is already with the courier, cancellation requires initiating a return (see Section 7 – Right of Withdrawal).
* BACKGAMMONSHOP reserves the right to cancel orders in cases of payment refusal or invalid/incomplete buyer information.
* BACKGAMMONSHOP may propose similar substitute products if stock issues arise; if refused, a full refund will be provided.

## 5. DELIVERY CONDITIONS
* Confirmation email with tracking link provided upon courier handover.
* Deliveries only within Romania.
* Free delivery for orders above 200 RON; 19 RON for orders under 200 RON.
* Delivery time: 3–5 business days (9:00–18:00).
If delivery fails twice, the parcel is held for 15 days; after this, refusal is treated as contract cancellation with penalty equal to incurred delivery cost.

## 6. TRANSFER OF OWNERSHIP
Ownership transfers to the Buyer upon delivery after final payment. Delivery is confirmed by signature on courier documents. Any refund results in products returning to BACKGAMMONSHOP ownership.

## 7. RIGHT OF WITHDRAWAL (RETURNS)
7.1 Buyers (consumers) may withdraw within 14 days of receiving products, without justification.
7.2 Return requests must be submitted by email to **[support@backgammonshop.eu](mailto:support@backgammonshop.eu)** before expiry of the 14-day period.
7.3 Only full returns (entire order) are accepted; partial returns are not.
7.4 Costs of return shipping are borne by the Buyer.
7.5 Refunds will be processed within 5 days after products are returned and inspected, using the same payment method (unless agreed otherwise).
